The Horses Mouth


Folks:

 In time for Thanksgiving I give you this gift of the “horse’s mouth” or your choice of anatomy.

It is important that when talking to government that you talk “government talk” (i.e) use their language as best as possible to describe what you received. When you read the arrow highlights in this attached piece, you will see what the government terms “GUIDANCE DOCUMENTS.” I want you to examine the extensive list and some of the handy revelations.

 Here is how you can use this gift from government:

 IRS LETTER:

 Dear IRS Employee,

 I received your letter demanding a [response, return, payment, etc]. The Federal Register Vol. 72, No. 16, Page 3432 identifies these vague mass-spam publications as “GUIDANCE DOCUMENTS” [attached]. You must have sent this letter to me by mistake for it makes threats of policy that the same Federal Register identifies as binding on government employees as policy. Please correct your records as I am not an employee of government.

 EMPLOYER LETTER:

 Dear Mr Bean Counter (Too Anxious to do the Work of Government):

 I am not a government employee and I would conjecture you would not claim to be a government employer. Your letter makes reference to the IRS Manual and IRS Publications.  The Federal Register Vol. 72, No. 16, Page 3432 identifies these as “GUIDANCE DOCUMENTS” and are NOT legally binding but COULD indeed be binding on government employees as policy of that government agency.

 EMPLOYER IRS REJECT W-4 LETTER:

 Dear Mr Bean Counter :

 I am not a government employee and I would conjecture you would not claim to be a government employer. You received a letter from the IRS implying you have a LEGAL DUTY to reject my attempt to tell the truth on a W-4. It’s patently ridiculous that one could be given authority to demand truth and simultaneous authority to reject attempts to tell the truth. One authority or both must fall. The Executive Branch APA department is attempting to “clean up” such “poor information” that led you to receive such a letter. The Federal Register Vol. 72, No. 16, Page 3432 identifies these as in the category of “GUIDANCE DOCUMENTS” and are NOT legally binding but COULD indeed be binding on government employees as policy of that government agency. You will see in the document that legally binding documents would need to contain much stronger language commanding you to action. The IRS routinely and conveniently confuses their employees with yours. I have taken the liberty to ask the IRS if the letter they sent you was a “guidance document” and not binding on anyone outside government employment. The default answer is “YES”, so expect NO ANSWER.
